1. Scope
These General Terms and Conditions (GTC) apply to all orders placed via our online shop Masoumi Customs by both consumers and businesses.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is a natural or legal person or a partnership with legal capacity who, when concluding a contract, acts in exercise of their trade or self-employed professional activity.

3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
By submitting the order, you make a binding offer to enter into a purchase contract. Confirmation of receipt of the order will be sent by email immediately after submitting. The contract is concluded when we confirm the shipment of the goods or when the goods are delivered to you.
4. Prices and Shipping Costs
All prices are based on EUR. Local currency may be displayed automatically depending on your location.
According to § 19 UStG (German VAT Act – Small Business Regulation), no VAT is charged.
Shipping fees are calculated during checkout and vary depending on the destination country and the selected shipping method.
5. Shipping and Delivery
Shipping area: We ship internationally.
Delivery times:
– Within Germany: 4–8 business days
– International orders: up to 14 business days, depending on destination and customs clearance.
The delivery period begins after receipt of payment and may vary depending on product availability, order volume, and shipping destination.
If delays occur, we will inform you promptly via email.
Shipping providers:
Depending on product size and destination, shipping is carried out via DHL, Deutsche Post, or a comparable service. Tracking information will be provided automatically after dispatch.

7. Retention of Title
Goods remain our property until full payment is received.
8. Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day
– you or a third party named by you (not the carrier) takes possession of the goods.

by means of a clear statement (e.g., a letter sent by email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you all payments received from you, including the cost of standard delivery (i.e. the least expensive type of delivery offered by us), without undue delay and no later than fourteen days from the date we receive notification of your withdrawal.
We will use the same means of payment you used for the original transaction unless expressly agreed otherwise. You will not incur any fees as a result of the refund.
We may withhold the refund until we have received the goods back or until you have provided proof of having returned the goods, whichever occurs first.
You must send back or hand over the goods to us without undue delay and no later than fourteen days from the day you notify us of your withdrawal.
The deadline is met if you dispatch the goods before the fourteen-day period has expired – the goods do not need to arrive within this period. You must retain proof of shipment (e.g., a receipt or tracking number).
You bear the direct cost of returning the goods. We do not provide return labels or reimburse return shipping fees. If you choose a return shipping method that is more expensive than standard shipping, the additional costs will not be reimbursed.

9. Warranty
The statutory warranty rights apply.
For used goods, the warranty period is one year from delivery.
10. Liability
We are fully liable for intent, gross negligence, and injury to life, limb, or health.
In cases of ordinary negligence, we are only liable for breaches of essential contractual obligations (cardinal duties).
11. Dispute Resolution
The European Commission provides a platform for online dispute resolution:

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Installation, Use, and Product Liability Disclaimer
12.1 Professional Installation Required
Our products – particularly vehicle-specific components such as illuminated air vents, center consoles, and custom-made parts – are intended for professional installation by qualified technicians only.
Masoumi Customs assumes no liability for any damage, malfunction, or consequential loss caused by improper installation, unauthorized modifications, or incorrect wiring.
12.2 Functionality Test Prior to Shipment
All items are individually tested for full functionality before dispatch. In the rare case that a defect is discovered, you must notify us within 7 days of receipt of the goods.
12.3 Use at Your Own Risk – Not Road Legal
Certain products – including RGB lighting features, custom electronics, and show components – are not approved for use on public roads unless explicitly stated otherwise.
These items are intended for show purposes, motorsport, private property, or export use only.
Use on public roads is at your own risk. Masoumi Customs accepts no liability for fines, failed vehicle inspections (TÜV), legal consequences, or any damages resulting from unauthorized use in street-legal contexts.
12.4 Vehicle Modifications at Customer's Own Responsibility
Any vehicle modification carried out using our products is done entirely at the customer’s own responsibility.
It is the buyer’s obligation to verify compliance with local laws and regulations (e.g., technical inspections, registration, approval requirements).
Masoumi Customs is not liable for any loss of roadworthiness, warranty claims, insurance issues, or damages resulting from such modifications.
12.5 No Guarantee of Road Approval or Certification
Unless explicitly stated, our products are delivered without street approval, type certification, or conformity markings (e.g., E-mark, ABE).
By purchasing, you acknowledge and accept that no claim for road certification or legal registration exists for these products.
13. Contract Language and Governing Law
The contract language is German. German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
14. Severability Clause
If any provision of these terms is found to be invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory regulation.
